Strange murder case and acquittal

Summary: Identical twins get into fight (and I do mean fight, with hair pulling, etc.) while driving on the Hana Highway on Maui, a narrow winding road along a cliff above the ocean. The car goes off the road and over the cliff, the twin driving survives, the passenger who was apparently attacking the driver dies, and the driver is charged with murder (acquitted in a non-jury trial). The prosecution's case seems to have been based on some rather flimsy evidence that the driver intentionally drove off the road.

IMO, had the driver died and the passenger survived, there would have been a clear-cut case for murder, or at least manslaughter, but as it played out, I think the acquittal was correct. Given the apparently vicious attack on the driver, I'm not really sure how, barring a confession, you could prove intent on the part of the driver.
